LAW07066 0000 Emerging Trends in Business Law
This aim of this module will be to tie together the two disciplines of law and business and examine any emerging trends or contemporary issues. It is therefore envisaged that this module will change and evolve with the issues current at any given time. The 'Indicative Syllabus' is therefore indicative of the trends at the time of writing. Areas of study may include but are not confined to the following:
Cyberlaw has more broadly sought to govern the uses of information technology across the globe, in fields as diverse as intellectual property, fair use and copyright, to regulate the uses of blockchain, artificial intelligence and to detect and prevent crime in the form of cybercrime in Ireland. The module examines the role of the Central Bank and other regulatory authorities, as well as legislation to keep pace with multiple changes in this are of the law today.
The area of Social Media is very much an evolving environment and presents emerging issues that the learner will appreciate with a comprehensive and practical knowledge of the legal framework impacting social media in Ireland in an ever-changing environment.
The learner will be introduced to the latest developments in 'FinTech', the use of technology to deliver financial services and products to consumers in the areas of banking, insurance and investments, giving the learner an appreciation of legal issues arising with the most up to date technologies available in dealing with the financial aspects of a business.
Globalisation has changed the way we do business and therefore impacts on Ireland in new ways. The module will examine the impact of globalisation and the role of the World Trade Organisation (WTO) to highlight the diversity of markets and legal regulations when engaged in a global arena.
On completion of this module the learner will/should be able to;
Evaluate and become critically aware of emerging issues and trends in the fields of law and business.
Examine the relevance of information technology law and modes of legal regulation and enforcement.
Analysis and critique the field of Social Media Law.
Demonstrate an understanding of 'FinTech' and the legal impact and challenges surrounding ongoing developments in this area in running a business.
Examine the legal regimes and impact of globalisation on business law in Ireland.
Teaching and Learning Strategies
The teaching and learning strategy is one which is founded on student-centered active learning. The module is designed to accommodate blended learning. A range of Computer-Aided Learning (CALL) packages are available to support this module (e.g. Moodle, Adobe Connect, Panopto, Teams).
Module Assessment Strategies
Students will participate actively in their own learning and have the opportunity to reflect on their learning progress through continuous assessment which will contribute 50% of the overall mark. Assessment strategies may include case studies, paper/group presentations, case notes, essay or similar. Throughout the process, feedback will be provided.
The end of term examination is 50% of the overall mark.
Repeat exam/assessment will be developed as appropriate to assess failed components.
This syllabus may change to meet new and emerging trends in Business Law. The following are an example of the content:
- Explore the sources of primary and secondary law of relevance to information technology law.
- Evaluate the role of intellectual property, fair use and copyright.
- Appraise the intersection of other fields of public and private law with cyber law, such as human rights law, trade and property law.
- Examine the modes of legal regulation, enforcement and supervision of information technology.
- Managing legal risks associated with Social Media involving civil and criminal liability surrounding online content: Defamation and blogging, relationships between Employer and Employee.
- Internet Service Providers (ISPs) and hosting, caching and conduits.
- Online Advertising standards.
- Growth and expansion of the Fintech Sectors: Deposits & Lending, Payments, Investment Management, Insurance, Crowd Funding & Research.
- Legal aspects of the 'Tech' in Fintech: Blockchain, Big Data, Consumer Protection, IP and Asset Protection and Artificial Intelligence.
- The Role of the Central Bank of Ireland, the European Union and other regulatory bodies in this area.
Globalisation and Business law
- Impact of globalisation on business law in Ireland.
- The operations and functions various international legal regimes, including the WTO.
- International trade agreements.
- Regional trade areas, technical barriers, and direct foreign investment.
- Legal Implications of Brexit.
